During the hearing of the presidential reference regarding the interpretation of Article 63A of the Constitution, Chief Justice of Pakistan Justice Umar Ata Bandial remarked that the vote of no-confidence motion against the Prime Minister would be in any case, it is insulting not to count the votes.

The Chief Justice remarked that the real issue was the period of incapacity.

 

During the hearing, the Attorney General also admitted in the court that without a vote, Article 63A of the Constitution cannot be applied to any member of the Assembly. It remains to be seen what will happen to the member after casting his vote.

 

The Chief Justice remarked during the hearing that there is a procedure in Article 63A, the spirit of Article 63A cannot be ignored, the function of the court is not to fill vacancies, such matters should be resolved in Parliament instead of reference.

Further hearing of the case was later adjourned till tomorrow.

 

It may be recalled that the opposition parties have filed a no-confidence motion against Prime Minister Imran Khan in the National Assembly on which Speaker National Assembly Asad Qaiser has convened a meeting on March 25 and voting may take place on March 28 or 29.



The opposition has claimed the support of about 29 PTI members in the National Assembly, after which the government has been active in disqualifying dissident members under Article 63A and a presidential reference has been filed in the Supreme Court.
