The former prime minister filed a petition in the court through his lawyer Faisal Chaudhry in which the Election Commission of Pakistan and National Assembly member Raja Riaz have been made parties.

The petition contends that this illegal decision of the Election Commission is arbitrary, illegal, devoid of legal content and violates the established principles of law and the Constitution.

The petitioner said that "this illegal order does not conform to the principles laid down in the fair trial and it has been given without due process. The respondents have failed to provide proper reasons to justify the unfair order".

The petition said that the Election Commission had failed to adopt a transparent and impartial procedure during the hearing.

The petitioner said that the purpose of law and constitution is to protect the mainstream of democracy from the pollution of horse trading and floor crossing.

The petition further said that the Election Commission had completely failed to protect the Constitution and fulfill its legal obligation under the Election Act 2017.

The petition seeks annulment of the decision of the Election Commission to remove the reference.

Reference against deviant members
It may be recalled that a petition was filed by PTI in the Election Commission of Pakistan last month regarding deviant members.

In the petition, the PTI had filed a declaration and reference against 20 members of the National Assembly for disqualification under Article 63A of the Constitution.

The petition contends that more than 20 PTI MPs defected, leaving the coalition government behind.

However, the votes of deviant MNAs were not required to remove Imran Khan, as the opposition had managed to win the support of the ruling coalition parties.

Following the removal of Imran Khan from the post of Prime Minister on the night of April 9, his declaration against the deviant MNAs of PTI was sent to the ECP by the Acting Speaker National Assembly on April 14.

Last month, the Election Commission issued notices to 20 MNAs directing them to appear.

In their written replies, the deviant MNAs had said that they had neither resigned from the PTI, nor joined any other political party, nor had they voted against the line stated by their parties. Is.
